Terms and Conditions
These terms and conditions (“Terms and Conditions”) govern the ordering, sale, delivery and collection of food, and the use of the Website, online ordering via botswana.debonairspizza.africa and Telephone Service. These Terms and Conditions are binding and enforceable against every person that accesses or uses the Site or Telephone Service, including, without limitation, each user who registers as contemplated below. By using the Site or Telephone Service, you acknowledge that you have read and agree to be bound by these Terms and Conditions. You must not use the Site or Telephone Service if you do not agree to the Terms and Conditions.
- May create risk or liability for the user; and/or
- May compel the user to indemnify Debonairs Pizza or a third party; and/or
- Serve as an acknowledgement, by the user, of a fact.
Governing Law and Jurisdiction
This Website is controlled and maintained from our facilities in the Gaborone Botswana. You irrevocably agree that the law of the Republic of Botswana shall govern This Website and these Terms and Conditions. You consent to the jurisdiction of the High Court of the Republic of Botswana in respect of disputes which may arise out of your Access to This Website and these Terms and Conditions. To the maximum extent permitted by applicable law, You also irrevocably and unconditionally consent to the jurisdiction of the Magistrates Court (if We exercise proceedings in such Court) even though the value of a claim which We may have against You may exceed the ordinary monetary jurisdiction of the Magistrates Court.
Gift Card Terms and Conditions
These Gift Voucher Terms and Conditions must be read together with the Legal Terms and Conditions of the Debonairs Pizza Website and the Privacy Policy. They must also be read together with any terms and conditions that appear in the short message service (‘SMS’) containing the Gift Voucher.
A Gift Voucher may be utilised as payment or part payment for Goods at a Debonairs Pizza outlet.
No cash refunds will be given to You by the outlet in the event of any amount remaining on the Gift Voucher after purchase. The Gift Vouchers may not be utilised for any marketing and/or promotional activities, without the prior written consent of Debonairs Pizza. In compliance with the Consumer Protection Act 2018, all Gift Vouchers shall be valid for 3 months from the date of purchase..
By purchasing the Gift Voucher, you acknowledge the following:
- Gift Vouchers may not be refunded or exchanged for cash or credit
- Gift Vouchers may only be redeemable at outlets within Botswana
- Should a Gift Voucher be lost, stolen or misappropriated in any manner whatsoever by You, Debonairs Pizza will not be liable to You for reimbursement or compensation in respect thereof
- No interest will accrue to any balance on the Gift Voucher
- The issuing and/or sale of Gift Vouchers is within the sole and absolute discretion of Debonairs Pizza and Debonairs Pizza may withdraw the Gift Vouchers and/or sale thereof at any time
Disclaimer and limitation of liability
(‘We’ and ‘Us’ in the context of this disclaimer and limitation of liability includes Debonairs Pizza, their affiliated companies and subsidiaries). The purchase and use of the gift Vouchers are entirely at your own risk. We shall not be held liable for any errors, breaks in service, server failure, or downtime, failure in network, technology, or other support infrastructure required for the issuance and/or redemption of the gift Voucher or any error or any problems that may arise with the redemption of the gift Voucher and/or any claims relating to the use of the gift Vouchers.
Indemnity
You hereby indemnify us and Debonairs Pizza associates from any loss, damages, liability, claim, or demand due to or arising out of your use of the gift Vouchers or breach by you of these terms and conditions.
General
There will be times when the availability of the app may be interrupted for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and equipment that are beyond our reasonable control, and we will not be liable for any inconvenience, loss or damage suffered as a result of such interruptions. The app requires internet access to function. We are not responsible for any interruption to your use of the app due to a lack of internet connection.
These Terms will be governed and construed following the laws of the Republic of Botswana, and any disputes between you and us relating to these Terms will be subject to the jurisdiction of the relevant Botswana court. If a provision of these Terms is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect. Nothing in these Terms is intended to unlawfully limit or restrict any rights or obligations in terms of the Botswana Data Protection Act no 18 of 2024.
Delivery
Debonairs Pizza reserves the right not to deliver to certain areas for distance, security and/or safety reasons. Please check online or ask your nearest restaurant if you fall within their specified delivery area.
Delivery applies to predetermined areas around the selected Debonairs Pizza restaurants. Variable delivery charges apply based on distance from your selected Debonairs Pizza to the delivery drop off location. Check with your local Debonairs Pizza restaurant on applicable delivery charges. Free Delivery applies to all orders of P200 or more, within a delivery distance of 5km from the restaurant.
